Auction Terms and Conditions
Auction Procedure: This property will be offered in 4 individual tracts, in any combination of tracts or as a whole. Bidders will be able to bid on individual tracts, combination of tracts or the whole acreage at several different times during the auction. The property will be sold in the manner resulting in the highest total sale price, subject to the seller’s acceptance. The auction procedure, conduct and bid increments are at the direction and discretion of only the Auctioneer.
Acceptance of bid prices: The successful bidder(s) will be required to sign purchase agreements at the auction site immediately following the close of the auction. The final bid price is subject to the Seller’s acceptance or rejection.
Financing: Keep in mind that your bidding is not conditional to financing, so make certain that you have arranged financing if you need it.
Down Payment: Ten percent (10%) down payment on the day of the auction upon signing a purchase agreement immediately following the close of the auction. The remaining balance will be due on or before September 15, 2014 at the closing with delivery of deed. Property is being sold subject to any easements or right of ways of public record. Buyer(s) will receive full possession at the time of closing.
Conservation Reserve Program: The annual CRP payment of $5,075 will be prorated to the closing date. The successful bidder(s) on Tracts 3 & 4 shall agree to continue the CRP contract at the Farm Service Agency Office in Paris, IL.
Survey: Any need for a survey shall be determined solely by the seller. At the seller’s option, seller shall provide a survey for any tract where there is no existing legal description or where new boundaries are created by the tract divisions at the auction. Closing prices shall be adjusted to reflect any difference between advertised and surveyed acres. Costs of any survey work shall be shared evenly by the seller and buyer(s)
Title: Seller will offer title insurance on the property being offered in the auction in the amounts of the purchase prices. Seller shall pay the premium for the title insurance and all search charges related to the seller.
Closing: The closing will take place on or before September 15, 2014 at attorney Robert Anderson’s office in Paris, IL.
Mineral Rights: Buyer(s) will receive mineral rights owned by seller.
Tenant Rights, Hunting Rights & Possession: The tillable land on this property is currently being custom farmed for the seller. The new buyer(s) will receive 100% of the shares from the 2014 crop by reimbursing the seller for all costs/inputs for the 2014 crop. Hunting rights are open for the 2014 hunting season. Full possession will be given to the buyer(s) at time of closing.
Real Estate Taxes: The real estate taxes for Tract 1 will be pro-rated to the closing date based on the 2013 taxes due in 2014. The real estate taxes for Tracts 2-4 will be deducted from the selling price based on the 2013 taxes due in 2014. Buyer(s) will assume real estate taxes payable in 2015 and thereafter.
